India told the ICJ that immediate steps must be taken to stop Pakistan's from carrying out the death sentence of former Indian naval officer Kulbhushan Jadhav.
He also ordered Pakistan to inform the tribunal that it has implemented the decision, and stressed that ICJ decisions are binding on all member states.
India argued in a preliminary hearing at the United Nations court that Pakistan violated the Vienna Convention on Consular Relations by denying the condemned man access to legal and other assistance from India.
"Court considers it a failure on the part of Pakistan to present counselors to Jhadav", the president said. It also called for the court to restrain Pakistan from "giving effect to the sentence awarded by the military court" and to direct it to annul the court decision.
His alleged confession admitting he worked for India's external spy agency R&AW and his involvement in terror activities was extracted in a military custody, Salve said.
"This court unanimously decides that Pakistan shall take all measures at its disposal so that Kulbhushan Jadhav is not executed pending a final decision of this court in the matter". There is an urgency in the case as Kulbhushan Jadhav was at risk of being executed.
Pakistan, however, rejected the plea on the ground that India had no right to invoke the jurisdiction of the UN's highest court because the Vienna Convention does not provide for matters relating to spies, terrorists and those who indulge in espionage.
India: Jadhav was abducted from Iran in 2016, and that there has been no credible explanation by Pakistan how he was found there. "In the view of the court, this is sufficient to establish that it has prima facie jurisdiction under Article I of - 2 - the Optional Protocol".
Pakistan stated that a period of 150 days is given in the cases similar to Jadhav's. Pakistan argued that counsular access is not an absolute right under the Vienna treaty, and that a 2008 bilateral treaty between India and Pakistan supercedes it anyway.
While Pakistan Attorney General's Office termed the stay as "procedural process", the Foreign Office was found making conflicting statements after the verdict.
In his weekly press briefing, hours after the ICJ asked Islamabad not to execute Jadhav till a final order is passed, Zakaria said the worldwide court does not reserve any jurisdiction to hear a case that involves the national stability of Pakistan.
It will be a big success for India and a setback for Pakistan if the death sentence of Jadhav is suspended by the ICJ.
